It would have been stupid not because there have always been white men on the bench. It would have been stupid because it would be specifically racist.
All well and good that you think she should have chosen different words. She didn't though. She chose them in a prepared speech to Berkley School of Law students. That's not just a slip or an oversight.

Doesn't much matter. The DNC has the votes. Even if the GOP could block her I wouldn't argue they shouldn't. Obama is the President and he gets to pick the judges.
