Im glad they went this way on this issue. Read the DOD papers for the Guantanimo bay prisoners and your mouth will gape with disbelief. What we were doing was illegal in the first place and it was the only descion for the court to make!

I've yet to read Rasul and Hamdi in their entirety.

What Rasul seems to say is that the detainees may challenge their status as "enemy combatants" in US civil court.

This does mark a kind of victory for the detainees but may also signal a defeat. Consider this....

It appears that if they challenge their staus as 'enemy combatant' and lose then they may be held for the durartion of hostilities without being charged.

If they win, it appears they should be released.

Further, it may be that the detainees may be charged with a crime and if convicted they'll have to serve out a sentence.

Currently, it seems that people have been kept in Guantanamo until they've proven they have no further use and released - whether ot not they could have been convicted. Rasul may encourage the administration to try the detainees and convict them - it is uncertain what courts they must be tried in - I think a military court is most likely - these are non-citizens captured on the battlefield fighting Americans. If they may be tried in military courts it seems quite likely that they'd be fucked.
