Mandatory airchecking will almost certainly be required by the FCC -- now it's just a question of how and how much.
It's not a rule yet -- but the just-issued Notice of Proposed Rulemaking strongly indicates radio and TV stations will be forced to record and retain airchecks for 60 to 90 days, at least between the hours of 6am and 10pm (outside the "safe harbor"). The purpose? To help the FCC in its enforcement efforts, mostly for indecency, but also for sponsor ID questions and who knows what else. Make no mistake -- this idea is fast-tracked at the Commission. Comments are due July 30.
Complaints will be far easier to file with actual airchecks available -- and fines could become larger and more frequent.
Don't erase that incriminating evidence, is what the Commission's saying. Broadcasters are sure to call this looming requirement "burdensome" and "cumbersome." Makers of digital aircheck equipment are in for a bonanza. Canadian broadcasters won't be surprised: they've had to do this for years.
