It is nice to know that this had nothing to do with being concerned for the employee's health, and everything to do with saving a dollar here and there.

As a smoker, I know it is damaging to my health, and potentially damaging to others through second hand smoke. So I smoke in areas that are designated for smoking.

But I believe that this company was wrong, and this is a violation of an individuals rights. A company has no right to tell an employee what they can and cannot do outside of the job, and I am terrified to think of how much further this may go if the company actually wins out on this.

What is next? No oral sex for employees? Are they going to do black light tests around the mouiths of suspected homosexuals to see if there may be a crusty smudge lingering from the bukkake tournament from the night before?

I thought this was the land of the free. It appears that fact may be dwindling more and more every day.

well, the gist i get from the end of the article is that they would like to do the same with obese people ("lose weight of find another job!"), but there's some pasky law protecting fat peopel.

This isn't right at all. What if people drink out of work? Fat workers? What if your employer doesn't like penis? Can you get fired because you are a man? Or a woman who likes penis? What about dark hair? Dark skin?

fuck that, I know soo many people that use the I need a cig line to get outta working or sitting at their desk. Taking a smoke break 2-3 times every hour has got to slow down productivity. If I had a buisness I would hire non smokers, thats just IMO

I think smoking should be cut out of the workplace all together, if you cant hang with not smoking for 4 hours then file for disability under addiction.

gender, religion, race are protected classes..... smoker/fatty are not

Businesses are in the businiess of making money... saving costs by having fewer high rish employees is just good business.

the employer gets to make the rules and set the terms and conditions of employment.... don't like it? Start your own company that refuses to hire non smokers

They can regulate at work, that's fine, but that's going into people's life outside of work. I could care less but this one should be interesting.

But, if you had to pay to ensure your emlpoyees.... would you be happy knowing several engaged in an activity that was nearly guaranteed to cause significant and costly health problems which made your insurance rates more expensive... which made you byu cheaper insurance for yuor EEs which made it more difficult to attract/keep good employees because they want better benefits?

How about this.... would this solution be acceptable...

all EEs who smoke are inelligible for insurance....
