Male roommates, Common Law Marriage, No Gay Marriage in TX???

how does this work?

First, if I'm living with a male friend for long enough to qualify for common law marriage, are we married?

Second, how is this possible if Texas doesn't allow gay marriage?

Does anyone here really want common law marriage to be in effect either?

Seriously. I don't think I've EVER heard someone say "I hope we live togather long enough that if we split up then I can say we had common law marriage so I can get half of his stuff!!"

I guess it could be helpfull if a hetro couple was living togather for a while and one got hurt... Is that the original reason for it?

Afaik, Common Law Marriage is currently recognized in Texas.

lol - because the State recognized them - why they did that? Probably to avoid an injust property division from a couple who absent a ceremony and license (if they were even required at the time) would have been married.

Its a little more than just living together, people blow that shit way out of proportion. If you have never presented yourself as married together to a third party, or filed joint taxes as married with both signatures on the form together.........then you are not common law married no matter how long you live together.

You cant trick someone into being married by just living with them for a few years, both parties have to willingly enter the arrangement.

also they are able to enroll their partner in insurance, etc. It has a bunch of benefits.

I heard a case about some big baseball player in NY that had a girlfriend that lived with him. Went on trips with him... blahblahblah....

So he gets tired of her, and she tried to divorce him. He says they were never married but she still took him to court. Eventually, the case was dismissed because she never sat in the seats for wives at the baseball games, but you know it cost him a TON of money to fight that.

Also, I look at my Aunt Donice and "Unlce" Larry... They married, got divorced but still lived togather for 20-30 years. But if you asked Donice if they were married, you get a big fat "NO", but I NEVER knew untill Larry died 2 years ago. If she would have of died too, or vise versa, how could someone, such as myself, make a conclusion to if they had common law marriage or not? I didn't know for 25 years that they wern't married.

Common Law Marriage is way too shakey, IMO. If you want to be married, get married, if you don't, then don't.

Yeah! For sure!! Everything with the government works so well.... Like get a drivers license. That process is a BREEZE!!!
