Marijauna Legal in Denver!

yay! yesterday voters passed an initiative to make marijuana legal in denver for adults 21 and up. its about time. now we shall see whether or not the state passess an initiative to tax regulate and sell it. gives a whole new meaning to the term mile high city!

Okay, federal law trumps state law, but only in matters of interstate commerce. So does that mean that prosecutors must prove that the marijuana crossed state borders in order to bust somebody for it? To what lengths will the conservative administation and dea go to attempt to broadly define interstate commerse?

"DENVER - Residents of the Mile High City have voted to legalize the possession of small amounts of marijuana for adults. Authorities, though, said state possession laws will be applied instead.

With 100 percent of precincts reporting early Wednesday, 54 percent, or 56,001 voters, cast ballots for the ordinance, while 46 percent, or 48,632 voters, voted against it."

So yeah, those stupid federal laws always get in the way. If we hadn't have scrapped the Articles of Confederation for the Constitution, we wouldn't be in this mess. We'd be in other messes but that's beside the point.

They should have waited and put this on the ballot in '06. Weed laws are the only thing that can get the Boulder vote out 100%.

the enabling clause used by the Feds to assert federal jurisdiction in wholey state matters is the Interstate Commerce Clause.....

It was the central issue in the California marijuana club cases a years r two ago

the ICC has, imo, been stgretched to ridiculous lengths in order to achieve policy ends the court liked

See Justice Thomas' dissent in Gonzales vs Raich. He is suggesting that so long the marijuana does not cross state lines regarding the selling and trade of the product, and it's cultivated per each individual and sold in the same state, it's okay.

So if the people of Colorodo were to pass such a law backing this measure, I see the Supreme Court backing the voters of Colorodo.
