eHarmony Sued In California For Excluding Gays

LOS ANGELES -- The popular online dating service eHarmony was sued Thursday for refusing to offer its services to gays, lesbians, and bisexuals.

Carlson, who lives in the San Francisco Bay area, tried to use the site's dating services in February 2007. When she was denied access, she wrote to eHarmony explaining its anti-gay policy was discriminatory under California law but the company refused to change it, according to the lawsuit.

Carlson's lawyers expect a significant number of gays and lesbians to join the class action, which seeks to force eHarmony to end its policy and unspecified damages for those denied eHarmony services based on their sexual orientation.

Well, from the point of view that it's a service, and if a company can choose to not serve someone, I can understand that.

But, if there was a dating site that said was open to everyone but blacks, is that legal? If that's legal, then sure, the can make it exempt to gays. But if that's illegal, then gays should be included.

hey, i've got an idea, instead of whining about it, why don't they make their own edating site for gays/lesbians and profit? Oh, I know why, because it's easier to be victimized and sue.

not being able to use a dating service is a far cry from a denial of equal protection Micah.

There are some services that are offered to just men, some to just women, some to just children etc etc. This isn't something where anyone has a property right to claim they are being denied.

Being black isn't the same as being gay in a practical or legal sense.



I'm with you that its stupid of eHarmony and if they exclude gays out of a purely bigotted (as opposed to business model or other legit marketing purpose) motive then they are malicious pigs.... but being a malicious pig doesn't give the people they don't like a right to sue.

Legally, it should be. I see advantages and disadvantages to it not being that way, but to say "this minority group" is protected here, but "this other minority group" isn't is wrong. If blacks could be legally excluded from the site, then I would have no issue w/ gay being excluded.
And... apparently she won the lawsuit, so that would mean that CA disagrees w/ your statement.

And yeah, I personally have no interest in joining eharmony. you can't even see pix of ppl on there?!?!? I look at the site once and was kinda taken back that there was no option for "men seeking men", but I just said fuck it, and went to the next one...
