![]() | renters rights question
I've had a leak in my bathroom that I've reported on 4 occasions now. Each call is documented and available for me to view online. I've had them out several times to "fix" the problem. I know for a fact the issue with the plumbing is in the ceiling and would have to be ripped open to complete any real repairs. Here's my question. What, if any, legal weight do I have to get out of my lease ASAP? |

This is what I did.... I had a leak in my kitchen that was coming through the light fixture. I reported it like five times and they kept saying they were in there to look at it and it was fixed... each time it rained it would leak so I knew they were lying. I went down two weeks before rent was due and said that I wasn't paying rent until it was fixed. Two days later they say they were deducting the amount of rent that would be paid for the square footage of my kitchen from that months rent. I said okay. I decided to go take the light fixture down myself just to see what was under there and there was a ton of mold and there is no fucking way they took the light fixture down before I did because they wouldn't have left the mold. I went down the next day and told them to come look at this and by the end of the day they had come up there to cut the mold out. They ended up taking the deducation off my rent and making it permenant making my rent hella cheap. They also fixed the roof within two weeks time. Obviously with me having pictures of the mold up there and the copies of the repair requests that were taken over several months I had an open and shut case to take to a lawyer anytime I wanted... I decided instead to take the cheap rent. My suggestion is make sure to take pictures of whatever is happening and keep copies of those repair requests and go down there and demand something... demand money off rent or demand they let you out of your lease, I'm sure they will be accomodating.

I have legally broken a lease using the Texas Property Code. Here it is: http://tlo2.tlc.state.tx.us/statutes/pr.toc.htm Scroll down to Title 8. landlord and Tennant and click on Chapter 92 Residential Tennancies then it will bring up all of the sub-sections. Scroll down to Section 92.056 Landlord Liability and Tennant Remedies; Notice and Time for Repair and click on it and it will give you all pertinent information. I had this same problem and they were being assholes until I printed all of this out and came into the office with some ammo. I wote one demand for reapir and delivered it to management and waited for seven day and nothing happened. After seven days I wrote another demand for reapir and nothing happened. Then after another seven days I wrote a letter stating that I was legally breaking my lease under the Texas property Code Title 8 Chapter 92 Section 92.056 provisions and they could kiss my ass. I received pro rated rent back, all of my deposits and everything. Worked like a charm. Knowledge is power. |

Sent them a certified letter on Monday, they received it Tuesday and I have yet to hear back from them. The letter clearly states that it is my 5th request and for them to "do something" to resolve the situation without me retaining legal counsel. I guess I'm going to need to find an attorney so I can get the hell out of there before the baby is born. |
