I thought there was some nation wide ruling where they can't force you to give blood, urine, or poop. That's why they take hair samples when testing for pot. All you crack heads out there should fight this because this is just a gateway to removing your civil rights. It will start with alcohol and then they will draw blood for drugs.

"If a driver refuses to give a blood sample, police will obtain a search warrant requiring compliance."

How long does that warrent take to get, you could do a whole lot of sobbering up in that time. I have to agree though, don't drink and drive, but don't vote for a police state either.

Here is a tip that might work. If you are plastered and hungry coming out of the bar. Walk over to the pizza place and order a pizza and say you want it delivered. Then tip the driver to deliver you with the pizza. Your milage may vary.

They don't force you to give it up...they get a warrant signed by a judge to take yo shit...besides, what about the civil rights of the people that get killed by drunk drivers?

this is a harsh deal though..... i support radical movements to stop drinking and driving.... but asking for my fluids is going a bit far.

Exactly. Plus, how are these officers trained? Are they trained to ensure sterile conditions or on how to maintain the integrity of the sample?

I can see these laws being overturned as soon at the first case of staph.

Just to play devil's advocate, I always find it amusing that police complain of "not enough manpower" as an excuse to rationalze the increase of violent and theft crimes, especially in Dallas and Ft. Worth, but then have plenty of people for road blocks and now phlebotomy.

Dear police, please focus on murders, rapes, assaults, and grand theft auto and not other less-frequent and less-dangerous DUI type offenses. It's painfully obvious that the reason you want to crack down on DUI/DWIs is because they make cities money. Seriously, we have had the worst over-all crime rate in the country for nearly a decade.
