If there are underage girls being forced into marriage with older men then the state should surely intervene. But I can't help but think their case may fall apart unless they get some incriminating testimony from the interviews with those children who very well may have been brainwashed their entire lives. The only cause to raid the compound was a phone call from a 16 year old girl who may not even exist, who was forced to marry someone who didn't even live there, I don't think they don't even know who she is. At least it didn't turn into another Waco...

Consent to marry at the age of 14 is very much a state issue. Judicial approval is required for anyone under 16.

Obviously yes.. but my point is, can they prove it? Even if they do, that is a crime committed by one man who didn't even live there, and he will more than likely get locked up. But unless they get more information from the kids they are interrogating I don't see how they will be able to take all of them away from their parents.

the law in texas is that a girl under age 16 cannot marry (not even with parental consent). that whole "sign off" so you can have underage sex is a sick urban myth probably started by hopefully manipulative, degenerate pedophiles.

i saw a special on pbs and one of the points they made (pro) was that in their communities all women end up marry even ugly ones and old widows. sometimes these marriages are never physically consumated it is just a way to keep the widow from losing the farm & such (in their opinions).

the kids that grow up in that style of spirituality are shocked not only by premarital sex but even kissing. there is very low instances of std's as well. the girls feel they have the right to choose their mate even though it has to be approved by the church elders. divorce is rare.

fundamentalist polygamy is not the same is post-modern polyamory (which is more what our friend sparks practices).

to me it all sounds like the religious leaders (including joseph smith) got a wandering eye as they grew old and used their power to seduce young women and created a dogmatic loophole to stay out of the doghouse with their first wives.

i guess it would sound like more of a benefit to the wives if they were a harem instead of wife-sisters. but the bottom line is CONSENT. i think i could only enjoy a harem if everyone chose to be there and they were all intelligent and old enough to make that kind of personal decision.

the girls in the FLDS are not old enough to be sexually active in the eyes of the law (and me). this inbred community of religious zealots is not protecting their daughters but repressing these girls freedom of choice and hard earned personal reproductive rights.

her body her choice. not her parents or arranged suitor or clergyman.

in america ladies can vote, choose birth control, own property and pick her own husband WHEN and IF they choose. & these girls were just children. marrying them off this early is definitely a form of child abuse (pedophilia).

The rules regarding void and voidable marriages as well as parental consent and or judicial approval require us to know many facts if we wish to apply them to this case. Not going down that road and you don't want to read it

For my part what meant to say is that if these 14 y/o girls were not wedded with the sanction of the state then whether the girls wanted to be married or not is not relevent. They would not be married in the eyes of the law and therefore any sexual contact with an adult (outside a statutorily excepted range) would be a crime regardless of the girl's consent or lack thereof.

And yes, this is entirely a state issue.

The minimum age for marriage in Texas with parental consent is 16. Parents must be present and give written consent. Each under-age applicant will be required to provide a certified copy of their birth certificate. The consenting parent must provide some form of government identification such as a valid drivers license. If the natural parents are divorced, the parent given custody must be present and give written consent and present a certified copy of their custody papers. Documents are required to establish that a prior marriage has been dissolved.

Judicial approval is required for anyone under the age of 16 to marry. Individuals who are 16 and 17 must have judicial approval or parental consent.

i always thought texas was a signoff state. (that's probably what the polygamists thought too) but the morning news said different yesterday. i was surprised (pleased, but shocked)

Not on that site. I could probably find it in Texas's judicial code somewhere but I'm too lazy and something tells me I don't want to know.
