Because it can't.....otherwise, every law would state "has to be" instead of "should be". And I think it's rather unfortunate that people feel the need to dig in on Bush when he holds the US Flag up in a show of pride for the US Olympic team....

It's stated "should be" because they intended the flag code as a guide to civilians, not as absolute law with enforcement provisions. It is, however, the ruling guidelines within the government.

Bush held the flag correctly. It was the entire audience that was backwards; in front of him, next to him, and behind him. He is the decider and however he decides to hold the flag is correct. That should pretty much end the whole argument. I'm surprised no one mentioned it yet.
