Yes, you can sue them for wrongfully denying coverage but you cannot sue the gov't for same. No, it doesn't bring anyone back from the dead but it does tend to police the system such that bcbs is less likely to deny coverage in subsequent cases while the gov't bureaucrat will have no boot up his ass. Ever heard of a federal employee getting fired? Its a near impossibility... firing a claims manager isn't. I'm not even remotely calling private "good" I'm saying it's less bad.

Again, I don't trust trial lawyers anymore than the gov't or insurance companies... but, they are the maggots feasting on the putrified parts of the insurance industry. They clean up the wounds.

None of this is anything like what I would prefer - I'm talking the best worst options here.

and often just the threat of suit or even threat by employee's employer to change providers is all that is needed to get the insurance company to cough up quickly, as it was in my case. give the power to the government and you have no choice, no recourse, and can only do what they tell you to.

and i still don't get why some of you guys assume the government wouldn't operate in the same manner as regards to trying to deny coverage to save and earn more money. it would be the same only worse, because they would be government employees that could not be sued or fired. maybe you believe it to be true because thats what obama has touted? if so, i don't buy it.

None of my opinions have come from obama. Just going by what i know and deal with daily concerning CMS vs private payors.

I have never looked for suits against the CMS. Cant and dont beleive that everyone just takes CMS for what they are/do, but I havent looked into it yet. There is always a path for recourse. May have to look that up when I get some freetime.

So should we do away with CMS since its controlled by the govt and it cant be working either since the govt is involved.

that's a false choice though. No one is saying get rid of medicare or medicaid

All I'm saying is that amongst a group of people I trust to be untrustworthy I think gov't bureaucrats are the least of them and that recourse against private insurers is more likely than against the gov't.

i love when people use medicare as some sort of government success story. politicians went straight from "medicare and social security is broke" to "look at medicare, whats the big beef with government healthcare?"

anybody catch the story the other day of the woman in orgeon (government healthcare touted by dems as a model) where she had cervical cancer and the government denied her meds for the cancer treatment but would approve meds for assisted suicide?

Please, when in defense of fighting off Gov Healthcare, refrain from using ANY words that are the same, or even like, those that have come out of Sarah Palins mouth. That does not help in the least bit.

I just think that if the gov can't even man up and say that YES they are keeping your email address on file, even if its not for an Enemies List, what makes you think they'll be honest or forthcoming about anything else concerning your healthcare (or anything else for that matter)?

why do any of you trust the gov to control your HC more than a public entity that can be sued or put out of business? The only way you can put the gov out of business is a revolution. And I don't think any of us would take it that far. We'd just say "Aww man, this sucks" and go back to watching American Idol.

no one said that cms is the end all be all of awesomeness. you guys sure do like to run with stuff. maybe you should both have a segment on rush limburger's show

cms will be bankrupt within the next 10 years if nothing changes - that is a fact. cms has worked (its not perfect by any means). people use it as an example due to the fact that its the only govt program for the less fortunate to this date.

so no one has any comments on recourse to cms? i guess i will ask around about it.

yea, medicare is not a good look for universal healthcare. our gov't can't devise a system to take care of the poorest of poor and the elderly who paid in their whole lives, but lets go ahead and railroad a bill through to take care of everyone. what percentage of our gov't budget is wrapped up in cms??

Like I said, as much as I despise the plaintiff's bar, some of their suits help prevent insurance companies from getting away with doing to another person what they did to the dead guy who's estate is suing. Its a form of regulation through lawsuit.
