Sucks that happened, Sabrina. I went through a similar issue with my Jag when I got it. The AC went out and the dealership took 3 weeks to get it fixed. It took me calling the service department every hour, on the hour, for three days to get it fixed. If my contact wasn't available I'd ask for anyone in the service department and bug them about it. I guess that the squeaky wheel gets the oil, because after the first day of nonstop calling they had somebody working on it and got it fixed asap.

Merritt's right about the lawyers though - it'll cost way more than it's worth, and you'll probably lose in the end.

this isn't one of those "i got hurt in an accident and you haven't paid up yet cases." those are taken on those conditions because they are guaranteed wins. the fault is easy to prove.

Yeah, a lawyer is just going to overly complicate things at this point. Bugging the shit out of them is the way to go right now.

Some of the details I've left out lend me to think I still have a case.

If it were just "they're taking too long to fix my car" I'd suck it up and keep bugging them.
I'm looking now because I have good reason to believe that this is not going to be the end of the issue. There are a few possible outcomes, some of which would make for a hard case.. Others would make for an easy case.

Why are you calling? Go up there and bitch at them in person. Preferably in front of customers.

Getting a lawyer is just going to cost you money. I doubt you could claim any real monetary damages unless you're paying for a rental out of pocket. Well, that an reimbursement of legal fees.

Yea, what Sepania said. Have you even gone up there and talked directly to the owner of the dealership, the owner of the mechanic place your car was then taken, and then taken after that? If you want to find your car, get off your ass and look for it, don't just expect that making phone calls is going to get anything done. Just making calls shows all those people that you really don't even care that much. I'd be angry as fuck, at every single one of those businesses, yelling at everybody who claims they are in charge, till something gets done. Have you done that?

she has spent hours up there in person already.

at this point they haven't given her car back. won't give her a date to expect it & won't tell her where they are keeping her car.

i think its pretty damn close to theft imho.

i say call the cops and have them go up there with you next time to demand the car back.

I would go up there daily and demand to speak to the manager until something changes. I would bug them so much all they would want to do is get the car fixed so they don't have to deal with me every again.

So I am assumng that this dealership wasn't a very established dealership?? I'm asking because all of this sounds pretty shady to me. I can't imagine this happening at a car dealership. It sounds like theft to me. if you have already been up there and they won't tell you where your car is and what is going on then I would demand it back by 5:00 today. If you don't see it I would get the cops involved. I'm assuming you have all your paper work from buying the car right?

it sucks that this has happened. unless you can prove that they are using the car or whatever... then you may have some sort of case, but i'd leave it at small claims after you get the car back. some car issues take time. i know a truck that has been out of commission for some engine noise for over 3 weeks. it's almost as if they want to turn it into a test case and write about it in medical type journals for cars & trucks. they also could have wrecked it... just some other possibilities. instead of calling, go up there and find out where your car is.
Pretty sound advice. Sadly the value of the case to an atty is low and the cost to you would likely be high with regard to the costs/savings.

I understand your issue right now is finding out where your car is. You may call the seller to whom you gave your car for repairs and ask them where it is etc etc and suggest to them that you have considered reporting them to thr BBB or reporting car stolen last known whereabouts their lot if they continue to stonewall you. Sorry you're having to deal w/this BS.
