Mean Apartment ladies

Ok so granted my ass should have braved the cold last night and dropped the shit off at night but here is what went down.

So i woke up early to get my rent check into the drop box before they opened at 9 which they always open at. I get there at 830 and they are open so i walk in and the lady is inputing the checks from the night before so here is how the dialog goes...

Me: Hey sorry i thought you guys oppened at 9 blah blah blah my work didnt deposit the check and it didnt clear till last night at midnight.

her: well its late after midnight on the 3rd

Me: well do you have somone here that picks up the checks at midnight?

No: but its late and ill have to chaarge you

Me: cant you just input my check with the ones your inputing now?

Her: No its late

Me: Well can I pay the late fee on my next rent check

Her: No I ll put a note on your door and you can pay next week.


WHAT A BITCH!!! She could have been cool and just let it slide but she had to get all textbook on me, fuck her!!

Yea that's some BS. Most apartments will at least let one slide. There's really no reason why she couldn't let this slide either if she was in the process of inputting them.

Yes, which is the reason I cant really bitch. But to be fair my office didnt put the funds in till midnight on the third. should have walked my cold ass to the office at midnight.

We have to mail off our rent check two weeks early because our land lady's father will throw a hot water burn baby coniption fit if it arrives a day late. Apparently the fucking Pony Express is still taking mail out to Phoenix because it takes about that long for it to arrive. We put up a grand for the deposit on this place, keep it impeccably and were late paying once for it because of the mail lag and he wrote us this vicious letter saying how we were going to be charged 50 bucks extra because the check showed up on the 2nd. We didn't pay because our LL stuck up for us but still, what an old fuckhead. He must be used to dealing with total deadbeats.

She could let it slide but if she does there has been a modification of your rental contract and the new term through course of dealing is that you get to pay your rent late free of late fees. That's possibly why she didn't let it slide... though the bitch factor may well be a better answer.

You could have just wrote the check the day before and dropped it off. Its not like they cash them the same day or the instant you put it into the drop box.

Tried that before and got fucked, they do deposit the same day. Even post dated the check and they still pushed it through, bastards

The Texas Property Code states that as long as a mailed rent payment is postmarked by the day it's due, it's considered paid on time. You might want to educate your landlord on this - it doesn't matter if he's in Arizona or not, since it's a Texas lease. PM me if you need chapter and verse to throw at him.


Oh yeah Sean, what time is your apartment complex supposed to open? If it's 9 and she was there early, then you should be able to get your late fee waived. The rent having to be there at midnight is unenforceable since they don't have anybody to check up on it - what it really says is that the rent needs to be there by the time they open on the 4th. If she was there early, then you still complied with their rules and shouldn't be liable for a late fee.
