question regarding child support/signing over rights...

what would i need to do in order to have rights taken away from my ex-husband regarding our daughter? it's been close to two years since he's even tried to make any kind of contact. above & beyond that i've not seen one dime from him since our divorce & thought that the courts would handle up on that. all they have done is sent him and myself a letter requesting payments & nothing has come of it. he'd moved from one place to an apartment in mesq. but, i can not get ahold of his complete address [lacking apt. #]. i don't know how to go about getting that info either & am NOT willing to hire a PI to find out.... would the property manager help me? or would i have to do some investigating myself to find out?

personally i'm tired of even thinking about it all & not getting the aid i need so, i'm thinking of opting for full rights. any suggestions?

TPR.... you can move the court to do it but if he objects its a tough row to hoe

Also... sounds like you have what you want right now anyway... he's exerting zero influence of any kind on your child.

Lastly, I believe if you get a TPR you also absolve any child support duty.

Im no authority but I believe he has to sign over his rights. You can get his job to start garnishing his check but then he can just quit his job. My little bros dad is a deadbeat and thats what he does. Then its a pain to figure out where hes working.

Quitting his job does nothing to eliminate his obligation.

Failure to pay child support can be a crime and in some cases rises to the level of felony.

SunAlso... what's your goal? Money or getting him gone? If it's money and you have an order from the court about child support you need to enlist the help of the child support office in the county that issued the order.

well indeed i do have it "my way" i suppose. i'd given him a year to get his shit together....went out on a limb too many times in order to persuade him to get stable enough to have any visitation rights [in which case have been the monitored type].

at this point i'm sure he can't really say/do anything to object, the courts would take one look at his record & our divorce decree & make it so. [my assumptions] i guess i'm more or less venting.....

he can't have his wages garnished because he doesn't have a real job [again i'm assuming because i don't know].... does recycling metal count as a real job? can you get taxes taken out of your payments? lol

tis the season & i'm sitting here with child in arms explaining to her that it ISN"T HER FAULT that she doesn't get to see daddy [sperm-donor] for christmas, holidays, bday in jan. etc. fucking asshole.

Oh I know. But everytime they start garnishing his check (the only way mom ever gets any support) he quits. The child support people can never seem to find him. Mom usually does after a while and the cycle begins again. It just seems like a crappy system to me. It is in OK and all the shit up there is pretty

i would love to get some type of monetary restitution before i completely sever ties but, i'm not sure what avenue to use to go about it. i've already been in communication with the attorney general's office & filled out a 10 page report with all the details i had. however, he's moved since then & i tried contacting them to explain that he has moved locations & i have the apt. info but, no #. to which they replied that they could do nothing until i had the one #. DAMMIT!

Termination of parental rights. This is extremely difficult if he objects. Few rights are to be regarded as sacred as that of parent/child.... yes, even when he's a fuck up. A TPR forever severs the legal tie.

The child support agency in the county where the order regarding child support etc is filed... they may or may not be willing to help.

he's in violation of a court order... he can be found in contempt and tossed into the clink for violating that order. If you find the right judge he could be very helpful. I worked with a judge who'd toss people in quickly... for a couple days. If they did it again... a few days longer. Eventually they figured out they better pay or they'dpending more time in jail than they cared to do

or he gets unearthed. If you pursue and he's held in contempt warrants can issue. If so and he comes into contact w/the police... they can haul his ass to jail.

But, as a general rule... yeah, pretty much fucked unless you can get the county to work for you... and even then...

Not an enviable position. Merritt's right - about the best you can do is move on and try to get along as best you can w/out placing any reliance on dear old daddy.

You need to contact the Texas Attorney General's Office (Greg Abbott) and they will have that information for you or should.

Unfortunately, you cant sign over his rights, no matter how mad you are at him. It's not that easy. HE has to do that. If he is willing, then good. Yeah for you. If not, then it's a court case that has to happen, and costs involved that arent pretty.

yeah, i've done that. i have a feeling that if i were to go for the jugular on this he'd resist. so that would leave me still in the same place i am today. i'm fully aware that i myself can't sign away his rights in any case, personally he DOESN'T DESERVE ANY. it's beyond "mad" at this point. it's been over 4yrs. yes, i figured that if i were to have to fight him over the rights it could put me further into financial duress. ugh. i've been doing fine for us the past 4 yrs. i'm just seeing if i have any options for getting the much needed aid i deserve.

You've contacted the AG, and what? What has been said or done? You can have his name and picture put up on their website for being behind in his dues and the amount shown. It gives people the opt for seeing his face and turning him in. He can be arrested for such a thing, ya know? I was actually on their website, looking around this a.m. LOL Small world.

surely his lease a legal binding contract would AT LEAST pop up. You have to stay on their asses, call everyday.
