Dena Schlosser, the Plano mother who killed her baby in 2004 by cutting off her arms, will be released from a mental health facility to go into outpatient treatment, a Collin County court has ruled.

'I felt led to do it,' Plano mom told doctor

She is slated to be released sometime within the next month, prosecutor Curtis Howard said today. The ruling was made on Thursday.

Ms. Schlosser severed her 10-month-old daughter's arms with a kitchen knife in November 2004 because, she said, she wanted to give the baby to God.

In April 2006, State District Judge Chris Oldner found her not guilty by reason of insanity at her second murder trial. Her first trial ended in a hung jury.

It is unclear where Ms. Schlosser will live after her release. Her mother, Connie Macaulay, has died. And she is prevented from seeing her two surviving daughters according to the terms of her January 2007 divorce from John Schlosser, who moved with his daughters to Weatherford.

Outpatient treatment?

What does it take for someone to get committed for life to an institution nowadays? Jeez.

The laws on this stuff have become way too lax IMO.

edit - On a side note I would, at some point, like to read up on mental health laws to see how they have changed over the past 50 years. I think less people are committed nowadays than in the past and I think that attributes for a lot of the serial killers and wackos we have out there in the streets

A person institutionalized due to a finding of insanity at criminal trial can only be held as long as the insanity persists. If her docs say she is well - they cannot keep her.

Legal insanity is a product of several cases M'naughten Durham and another I forget. Different jurisdictions have slightly varying rules but the general notion is that in order to be legally insane one must fail to understand the nature of their acts and recognize that they are wrong... which is pretty much the M'Naughten test

You're asking why an insane woman didn't find a more humane way to kill her infant daughter? I think the shortest answer is.... because she was fucking insane.

ftr - the insanity defense is nearly always rejected by a jury. All a prosecutor really needs to do is show some evidence of concealment of the crime - which demonstrates consciousness of guilt ie that defenant knew what she did was wrong and therefore not legally insane

You can think that but you'd be using Kelle's definition of legally insane not the law's definition. Kelle's is not a valid defense at trial.

If someone is not deemed legally insane for chopping up their child, I don't want to know what one has to do to be considered insane.

If she's not "legally insane" then she's fit to serve time in prison for the rest of her life. imo
